ScanMeSaveMe (Pty) Ltd — Reg. No. 2026/264832/07 — Kempton Park, Gauteng, South Africa

Part 1 — General Disclaimer of Liability

Last updated: July 2026

1. What this product is

Scan Me Save Me provides NFC tags and a companion mobile application that allow a user to write information of their own choosing onto a physical tag, and that allow any compatible device to read that information when the tag is scanned.

ScanMeSaveMe (Pty) Ltd ("we", "us", "the Company") supplies the tags and the software used to write and read them. We do not create, verify, moderate, or guarantee the accuracy, completeness, or currency of any information a user chooses to store on a tag. We act solely as a technology provider and gateway through which user-supplied information is written to and read from a physical NFC tag.

2. No verification of user-supplied information

All content stored on a Scan Me Save Me tag — including but not limited to names, medical information, allergies, emergency contacts, dates of birth, identification details, pet information, payment links, business details, or any other content — is entered entirely by the user (or by someone acting on the user's behalf, such as a parent, guardian, or caregiver).

We have no ability to verify that this information is accurate, current, complete, or that it relates to the person, animal, or item the tag is attached to. The Company makes no representation or warranty, express or implied, as to the truthfulness, accuracy, or reliability of any information stored on or displayed by a tag.

3. Emergency and medical information — specific notice

Some tag types are designed to display medical, emergency, or identification information intended to assist another person (such as a paramedic, bystander, or member of the public) in an emergency. The Company does not guarantee that:

  1. the tag will be present, intact, scannable, or undamaged at the time it is needed;
  2. the information stored on the tag is current, accurate, or has been updated by the user following any change in circumstances;
  3. any person scanning the tag will see, read, understand, or act on the information correctly or in time;
  4. the device being used to scan the tag is compatible, has NFC enabled, or is able to read the tag successfully in every circumstance.

A Scan Me Save Me tag is intended as a supplementary aid and is not a substitute for medical identification jewellery required by a medical professional, nor a substitute for calling emergency services. In any genuine emergency, contacting the relevant local emergency services remains the primary and recommended course of action.

Important: ScanMeSaveMe (Pty) Ltd cannot be held responsible for death, harm, or injury caused by incorrect, outdated, or misleading information written to a tag by a user. The accuracy of all tag content is the sole responsibility of the person who wrote it.

4. No liability for reliance on tag content

To the maximum extent permitted by law, the Company excludes all liability for any loss, harm, injury, death, damage, or claim of any kind arising directly or indirectly from:

  1. information entered onto a tag by a user being inaccurate, outdated, incomplete, or false;
  2. a tag being lost, damaged, unreadable, or not scanned;
  3. reliance by any third party on information displayed after scanning a tag;
  4. misuse of a tag, including information entered with fraudulent or malicious intent by the user;
  5. misuse of tag information by any third party who scans it, including identity theft, fraud, stalking, harassment, or any other criminal or malicious use.

4A. No liability for technical or software failure

To the maximum extent permitted by law, the Company further excludes all liability arising from:

  1. technical or software failure of the app, website, or any associated systems, including bugs, crashes, downtime, or update-related issues;
  2. NFC tag misreads, failed scans, or a device's inability to read a tag, whether due to the device, the tag, environmental conditions, or any other technical cause;
  3. inaccurate display or reporting of medical or emergency information caused by a technical fault, rather than by the underlying information as originally entered by the user.

This clause does not exclude liability for death or personal injury caused by our gross negligence or wilful misconduct.

5. Data storage and privacy

Information written to a Scan Me Save Me tag is stored physically on the tag itself and, where applicable, locally on the user's device. The Company does not control, monitor, or have routine access to the content a user chooses to write to their own tag. Users are responsible for the lawful collection and entry of any information relating to a third party and for obtaining any consent required under the Protection of Personal Information Act, 2013 ("POPIA") before doing so.

6. User responsibility

By using the Scan Me Save Me app and tags, the user agrees that:

  1. they are solely responsible for the accuracy and lawfulness of any information they enter;
  2. they will keep tag information up to date as their circumstances change;
  3. they will not enter information that is false, defamatory, unlawful, or that infringes the rights of any third party;
  4. they understand the Company acts only as a gateway for the storage and retrieval of self-supplied information, and is not a verifier, custodian, or guarantor of that information's accuracy or availability.

7. Changes to this disclaimer

The Company may update this disclaimer from time to time. The current version will always be available at scanmesaveme.com/terms.html and within the Scan Me Save Me app.

Part 2 — Medical & Emergency Tag Terms

Last updated: July 2026

These terms apply specifically to medical and emergency tag types: Save Me, ICE, Disability, Child Protect, Take Me Home, Who Am I, and Club. Users are presented with these terms and must actively accept them before writing information to any of these tag types in the app.

Plain-language summary Please read these terms carefully. By agreeing, you accept that: you are responsible for the accuracy of the information you write to this tag; we don't store or have access to that information once it's written; certain high-risk details (like full ID numbers) can't be added; and we can't be held liable if the tag is lost, misread, or if someone misuses the information on it.

1. Purpose of this tag type

This tag type is designed to store medical, emergency, or identifying information that you choose to provide, so that it can be displayed to another person (such as a paramedic, first responder, family member, or member of the public) when they scan the tag.

2. You are the source of this information

Any medical or emergency information stored on this tag is entered by you, or by someone acting on your behalf (such as a parent, guardian, or caregiver). ScanMeSaveMe (Pty) Ltd does not create, verify, check, or guarantee this information in any way. We provide the tag and the software that writes your information to it and displays it when scanned — nothing more.

3. Your responsibility

By proceeding, you confirm that:

  1. the information you are about to write is accurate and true to the best of your knowledge at the time of writing;
  2. you understand it is your responsibility to keep this information up to date, including after any change in your medical condition, medication, allergies, or emergency contact details;
  3. if you are entering information on behalf of someone else (for example, a child, a dependant, or a person in your care), you have the right and authority to do so, and you have any consent required under POPIA;
  4. you will not enter false, misleading, or fraudulent information.

3A. We do not store your information

We do not store, retain, or have access to the information you write to this tag. It exists only on the physical tag itself, and where applicable, locally on your own device. We cannot retrieve it, correct it, recover it, or provide it back to you if the tag is lost, damaged, or your device is reset. You are responsible for keeping your own separate record of what you have written, if you wish to have a backup.

4. No guarantee of availability or accuracy when scanned

We do not guarantee that:

  1. this tag will be present, undamaged, or scannable at the moment it is needed;
  2. the device used to scan it will be able to read it successfully;
  3. the information displayed will still be accurate, if it has not been kept up to date since you last wrote to the tag;
  4. any person scanning the tag will see, understand, or act on the information correctly or in time.

This tag is a supplementary aid. It is not a substitute for medical identification jewellery prescribed by a medical professional, and it is not a substitute for contacting emergency services directly in a genuine emergency.

4A. Information is visible to anyone who scans the tag

This tag type is designed so that medical and emergency personnel, or any person assisting you, can read the information by scanning it. By its nature, this means the tag will also display this information to anyone else who scans it — including a stranger, a person with no genuine need for the information, or a person with harmful intent.

You acknowledge and accept that:

  1. you are choosing what information to include on this tag, and you are responsible for weighing the benefit of that information being available in an emergency against the risk of it being read by someone other than emergency or medical personnel;
  2. the Company has no ability to control, restrict, or verify who scans the tag or what they do with the information afterwards;
  3. the Company is not responsible for any misuse of the information on this tag by a third party, including but not limited to identity theft, fraud, stalking, harassment, or any other criminal or malicious use, however that misuse occurs.

4B. Certain information cannot be included

To reduce the risk of identity theft or financial fraud if this tag is read by someone other than emergency or medical personnel, you may not include the following on this tag, and the app will not accept these in full:

  1. your full South African ID number or passport number;
  2. your full home address;
  3. full medical aid, insurance, or policy numbers (only the last 4 digits may be included, where relevant);
  4. any bank account, card, or other financial account numbers.

If you need to identify yourself to medical personnel, consider including your name, a partial reference (e.g. last 4 digits of a policy number), and an emergency contact who can provide full details if required.

5. Limitation of liability

To the maximum extent permitted by South African law, ScanMeSaveMe (Pty) Ltd accepts no liability for any loss, harm, injury, or damage arising from:

  1. information you have entered being inaccurate, outdated, or incomplete;
  2. the tag being lost, damaged, unreadable, or not scanned in time;
  3. reliance by any third party on the information displayed;
  4. technical or software failure affecting the writing, storage, or display of this information;
  5. misuse of the information on this tag by any third party who scans it, including identity theft, fraud, stalking, harassment, or any other criminal or malicious use.

Nothing in this clause excludes or limits our liability for death or personal injury caused by our gross negligence or wilful misconduct.

6. No refunds or reversals for information entered in error

Because we cannot access or correct information stored on your tag (see Section 3A), errors in information you have entered are your responsibility to correct by rewriting the tag yourself using the app.

7. Governing law & jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be referred to the Magistrates' Court having jurisdiction, without prejudice to either party's right to approach a higher court where the matter requires it.

8. Consent

In the app, users are required to actively tick an unticked checkbox marked "I understand and accept responsibility for the accuracy of this information" before any write to a medical or emergency tag proceeds. This constitutes express consent under the Consumer Protection Act 68 of 2008.
